SPOTED.AM TERMS AND CONDITIONS OF SERVICE

 

Welcome to SPOTED.AM (http://www.spoted.am) – (hereinafter referred to as “SPOTED”)

 

Spoted is a platform for publishing (listing) and adverting information about various services, shops and shopping centers, entertainment and recreation activities and organizations, educational and development institutions mostly for children and teenagers, as well as providing programming, technical and other functionality for search, selection, rating of information and commercial advertising.

 

By registering on Spoted, you explicitly agree to these Terms and Conditions of Services (hereinafter – Terms and Conditions). The Terms and Conditions apply to and the rights and obligations defined by the Terms and Conditions are considered to have arisen, the consents and permissions are considered given by those Users of Spoted at the moment of registration on Spoted by agreeing and accepting the Terms and Conditions.

 

Moreover, the Terms and Conditions are considered accepted by the User from the moment of registering on Spoted and ticking the mandatory acceptance tick during the registration process.

 

The Terms and Conditions are set and may be changed unilaterally by Spoted and are always available on Spoted. Users are notified of changes to the Terms and Conditions no later than 5 (five) days before their entry into force, by making them available and publishing them on spoted.am.

 

The Terms and Coditions are considered agreed and accepted by the User if the later does not notify Spoted by sending a written notification by e-mail about the User’s desire to terminate the User’s activity on Spoted prior to the date for the new changes entering into force.

 

Personal page

 

  1. Under the Terms and Conditions, the User is a physical or legal entity (person) who registers on Spoted in accordance with the procedure established by the Terms and Conditions, in order to obtain information about other users, products and services presented on Spoted, make comments, evaluate and rate other users, products and services or publish or advertise information about goods, products, or services (hereinafter referred to as Listing).
  2. For registering on Spoted it is necessary to create a Personal page first and become a User, which is mandatory for publishing any Listing or advertisement.
  3. You need to fill in all the required fields on the registration form and set a password to create a Personal page. You can only register on Spoted if you are 18 (eighteen) years of age or older.
  4. Spoted does not bear any responsibility for reliability, completeness or legitimacy (legality) for the information provided by Users during registration.
  5. Spoted will communicate with you solely by e-mail and / or mobile phone number provided by you on Personal page. Spoted shall not bear any responsibility if User’s personal information or data becomes available to a third person as a result of input of wrong or incorrect contact details or contact details or information of a third person by the User on Personal page.
  6. User’s payment operations or card transactions made on Spoted shall be clarified by the User with the User’s bank or the card issuing bank.
  7. By registering on Spoted, the User is automatically subscribed to the news, offers and other notifications that may be sent or distributed by Spoted.
  8. Considering the possibilities and risks of fraudulent transactions as well as aiming to prevent such fraudulent activity, the Users are obliged to protect their Username and Password for Spoted, as well as details of their payment cards used to make online payments, never provide such information to a third person as well as never provide such information as a reply to any inquiry received by e-mail or personal message. Spoted will never ask you for your password by e-mail or telephone, and shall not be held liable if your data becomes available to a third person as a result of your negligence.
  9. Spoted has the right to unilaterally terminate the User’s activity if the User violates the Terms and Conditions of Spoted.

 

Personal data protection and privacy

 

  1. The User hereby explicitly agrees and grants permission to Spoted, regardless of the form and method of implementation (including but not limited to: automated, by using various technical means or without them), within the limits defined by the Law of the Republic of Armenia on Protection of Personal Data to analyze, process and/or use the data, including the personal data disclosed during registration and use of Spoted. Such agreement and permission by the User is valid for the entire term of service (use) of Spoted by the User.
  2. Spoted allows Users to send personal messages to one another in order to establish primary contact and exchange information about products and services. Such personal messages are not considered personal or private information or data and are subject to periodical monitoring by Spoted Administrator. Users are responsible for content of personal messages they sent. Personal messages cannot contain offensive, provocative content or threats, offers for sale of goods or services or advertisement of goods or services prohibited by the Legislation of the RA or requiring special license (permit), political advertisements or content, invitation or offers. Violation of personal messaging rules is a ground for unilateral termination of service by Spoted.

 

Payment

 

  1. Spoted allows Users to publish information about their products and services and to place advertisements. In order to purchase a paid subscription to Spoted or to place an Advertisement, the User can make a payment with his ArCa/Visa/Mastercard issued by an Armenian local or international bank.

 

 

Responsibility of Spoted

  1. Information published on Spoted, including but not limited to service providers, sellers, services, products, their description and features, prices, purchase options and process, as well as any other data is for information purposes only and is not considered to be a public offer. Such information is only considered an invitation to make an offer.
  2. Personal messaging between Users of Spoted shall not be considered an offer, an acceptance or a binding obligation or contract or evidence of such obligation or contract. No contractual obligation arises between a seller or service provider on Spoted and the User.
  3. Spoted shall not bear any responsibility for content of personal messages exchanged between its Users. Spoted shall, from time to time, monitor the personal messages and on the best effort basis discover messages described in p. 11 of the Terms and Conditions.
  4. Spoted is ready to provide maximum effort to ensure that most relevant and up to date information is posted by Users. However, Spoted is not liable for decisions, differences or changes made as a result of information published on Spoted, including but not limited to: service providers, sellers, services and products sold, their availability, features, peculiarities, prices or purchase conditions and terms. Users cannot submit any claims to Spoted in relation to the aforementioned or require the latter to compensate for the damages, costs or missed benefit incurred as a result of the above grounds or any one or more of them.
  5. Spoted does not bear any responsibility for the quality of any products or services listed on or advertised on Spoted, or provision of such services, timely delivery or any other issue related to the procurement of goods or services. Any claim or complaint related to goods or services listed on Spoted shall be presented directly to the User who has listed such goods or services and/or the provider of such goods or services.
  6. Spoted has the right, without any prior notice to change or amend any information published on Spoted, including but not limited to: information related to Users, their listings, goods, services, and any other information published in Spoted, including to shorten, edit or amend information.

 

Feedback, comments and opinions 

 

  1. Feedback options:
    1. Leave a comment on the User’s page or Listing, write an e-mail or call the contact number if you need to inquire about information, services, products, quantity, delivery or any other clarification;
    2. Write an e-mail to [email protected] if you have technical issues with registration, search, or publishing a listing on Spoted, or you would like to share your experience or make a suggestion for an improvement.
    3. Contact your Bank if you have issues or questions regarding your payment to Spoted.
  2. Spoted has the right to delete any offensive comment or opinion or aimed disqualifying the goods or services.

 

Paid subscription

 

  1. Spoted can have one or more paid subscription packages.
  2. Information about services included in paid subscription packages and prices of the packages is available Spoted.am webpage and are considered a public offer.
  3. Users pay one-time fee for the entire length and term of the paid subscription package (if not specified otherwise in the package description). The one-time fee is not subject to refund, reimbursement or recalculation, including in case of termination of subscription or subscription to a different package.
  4. Spoted has the right to send payment reminder messages to the Users by e-mail or another communication channel defined by the User during the month preceding the expiration of a paid package.

 

 

Termination of User’s personal page, deletion of data  

 

  1. You can personally discontinue / deactivate your Personal page on Spoted, disconnect or unlink it from another website and request deletion of all your personal data.
  2. Nevertheless, Spoted can contact the User during the Personal page termination process or immediately following it to request additional clarifications related to the discontinuation of the page.
  3. Amounts and fees paid for paid subscriptions packages are non-refundable and are not subject to refund, return or recalculation regardless of the date or terms of termination.

 

Disputes and Claims

 

  1. All disputes and claims between Spoted and Users arising from and related to the present Terms and Conditions shall be resolved by negotiation. In case of failure to reach agreement by negotiation within 15 (fifteen) days the disputes and claims shall be solved in accordance with the procedures set by the Legislation of the Republic of Armenia.
